Pay-Per-Lead Terms & Conditions

1. Definitions
"Lead" means a new, exclusive homeowner enquiry delivered to the Client via QuoteLeads' systems, comprising the data fields specified in Section 4.
"Batch" means the agreed quantity of leads purchased by the Client.
"Delivery Period" means the period during which QuoteLeads delivers the Batch to the Client.
"Outstanding Leads" means any leads from a purchased Batch that remain undelivered at the expiry of the Delivery Period.
2. Product
QuoteLeads provides lead generation services. Leads are generated via digital assets owned or controlled by QuoteLeads and delivered exclusively to the Client on a pay-per-lead basis. Leads are not resold, shared, or redistributed.
3. Lead Volume & Delivery
3.1 Fixed Quantity
The Client purchases a fixed quantity of leads as specified in the order confirmation.
3.2 Delivery Method
Leads are delivered in real-time during the Delivery Period via email, SMS, and/or API integration. Delivery timing depends on market demand. QuoteLeads does not guarantee uniform distribution of leads across the Delivery Period.
3.3 Outstanding Leads at End of Delivery Period
Where the Delivery Period has elapsed and Outstanding Leads remain undelivered from a purchased Batch, the Client will be notified. At that point, the Client may elect one of the following options:
- Continue Delivery: The Client may elect to have Outstanding Leads delivered beyond the original Delivery Period. QuoteLeads will make reasonable efforts to fulfil the remaining quantity in a timeframe agreed in writing.
- Refund of Outstanding Leads: The Client may elect to receive a refund for any undelivered leads remaining from the purchased Batch at the conclusion of the Delivery Period. This refund applies only to leads not yet delivered and does not affect payment obligations for leads already received.
The Client must notify QuoteLeads of their elected option within 5 business days of being notified of Outstanding Leads. Failure to respond within this period will be deemed an election to continue delivery. For the avoidance of doubt, all leads already delivered remain non-refundable under any circumstances.
4. Lead Data
4.1 Standard Fields
Standard lead data comprises: full name, email address, phone number, postcode, project description, and estimated timeline.
4.2 Custom Fields
Additional data fields (budget range, property type, ownership status, custom qualification questions) require prior written agreement.
5. Qualification & Verification
5.1 Filtering Criteria
Leads are filtered prior to delivery based on: service type, geographic area (within the agreed postcodes or kilometre radius), and real-time verification.
5.2 Verification Methods
- Real-time SMS validation
- Real-time contact verification via QuoteLeads' proprietary systems
Phone-call verification may be offered under separate agreement.
5.3 QuoteLeads' Discretion
QuoteLeads determines qualification methodology and retains sole discretion over lead acceptance into the delivery pool. The Client acknowledges that QuoteLeads' business judgment in these matters is final and not subject to dispute.
6. Exclusivity
6.1 Exclusive Delivery
All leads are exclusive. Each homeowner enquiry is delivered to one contractor only, based on service type, location, and qualification criteria.
6.2 No Redistribution
Leads are not resold, shared, or redistributed.
7. Payment
7.1 Pay-Per-Lead Structure
The Client pays the agreed rate per lead delivered. Payment is for access to qualified homeowner enquiries, not guaranteed sales outcomes.
7.2 No Outcome Contingency
Payment obligations are not contingent on: contact success, quote provision, or sale conversion.
7.3 No Refunds on Delivered Leads
No refunds apply to leads that have been delivered. The sole exceptions are: (a) the post-delivery scrub allowance described in Section 8; and (b) refunds for Outstanding Leads as described in Section 3.3.
Important: Lead generation is a volume-based service. Not every lead will convert to a sale. Conversion depends entirely on the Client's sales process, speed of response, pricing, and market conditions. QuoteLeads makes no representation about conversion rates or revenue outcomes.
8. Acceptance & Disputes
8.1 Immediate Acceptance
Each lead is deemed accepted upon delivery. The Client may not dispute, reject, or request replacement of individual leads during the Delivery Period.
8.2 Why No Mid-Stream Disputes?
Because leads are pre-filtered through QuoteLeads' systems. If it reached you, it met our qualification standards. Your sales process - speed of contact, pricing, availability, phone manner - determines conversion.
8.3 Post-Agreement Scrub Allowance
Following completion of the Batch, the Client may submit disputes for up to 10% of leads delivered, within 7 business days of batch completion.
8.4 Valid Dispute Grounds
- Invalid or non-working contact details (proven)
- Duplicate lead previously delivered to the Client
- Clearly fraudulent or spam submission
- Outside the agreed service area or service scope
8.5 Scrub Cap
QuoteLeads will replace or credit disputed leads at its discretion. The 10% cap applies regardless of the merit of individual disputes. Scrub requests over 10% are denied without escalation.
All delivered leads are pre-qualified and filtered to the agreed criteria prior to delivery. The 10% scrub allowance exists to absorb legitimate edge cases. Claims exceeding this threshold will not be processed.
9. Client Obligations
The Client agrees to:
- Respond promptly to leads
- Act in good faith when submitting disputes
- Not circumvent QuoteLeads' assets or systems
- Honour exclusivity and non-circumvention of QuoteLeads' assets
10. Termination
QuoteLeads may terminate access immediately, without refund, for: breach of terms, fraud or misrepresentation, misuse of leads, excessive or frivolous scrub claims, or attempted circumvention of QuoteLeads' assets or brands.
Termination does not negate payment obligations already incurred.
11. Modifications
QuoteLeads may update these terms. Where a modification is material, QuoteLeads will use reasonable efforts to notify the Client by email or through its platform. Continued purchase, access, or use of the QuoteLeads lead generation product after any modification constitutes acceptance of the modified Terms.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia, unless otherwise agreed in writing.
13. Entire Agreement
These Terms constitute the entire agreement between QuoteLeads and the Client regarding the pay-per-lead service and supersede all prior agreements, understandings, and representations.
